Government of São Paulo launches new tax transaction notice with discounts of up to 75%

The government of the State of São Paulo launched this Monday (8/9) a new public notice
of the Paulista Agreement, a program for negotiating tax debts. The notice
offers discounts of up to 75% on interest and fines, installments of up to 120
times and the possibility of using writs or accumulated ICMS
credits to reduce debts.
The benefits are valid for ICMS, IPVA and ITCMD debts enrolled in debt
active, in addition to fines applied by Procon. The deadline for joining is February 27
February 2026.
The program is supported by Law 17,843/2023, which established conditions for
the settlement of disputes related to the collection of state credits
registered in overdue debt. According to the State Attorney General's Office (PGE-SP),
after the launch of the São Paulo Agreement, in 2024, R$ 57.6
billion.
Check out the main conditions
· The amount to be transacted will be calculated according to the degree of
recoverability of credits:
a) irrecoverable credits will have a 75% discount on interest and fines
b) credits considered difficult to recover will have a 60% discount on interest
and fines
c) on credits considered recoverable, there will be no concession of discounts
· Discounts cannot exceed 65% of the total amount of the credits,
nor reduce the principal amount
· The taxpayer may choose to pay the debt in installments up to 120
months, with no down payment, with the possibility of using writs and credits
accumulated ICMS to reduce the debt
· Recoverable credits in up to 84 installments do not need to
present a guarantee. From 84 installments, the presentation
of surety bond, bank guarantee or real estate
· For credits that are difficult to recover or irrecoverable,
guarantee will not be required, unless already constituted in the judicial records.
